SALES TAX
Texas residents and businesses are subject to 8.25% state sales tax. Certain products are subject to sales tax outside Texas. You may be assessed sales tax on these certain items. 


PAYMENT
All prices are in U.S. dollars.


ALTERNATIVES TO ONLINE CREDIT CARD PURCHASES
We accept faxed and mailed credit card orders, as well as orders that are mailed with a check. 


PURCHASE ORDERS AND CORPORATE AND GOVERNMENTAL ACCOUNTS
Corporations and other organizations are evaluated on a case by case basis for terms. City, County, State and Federal Agencies are generally not required to be evaluated for credit worthiness except for larger orders (over $2500.00).


CHARGES
Credit card is not debited until your product is prepared for shipment.


SHIPPING TIME
Shipping times vary. Products that typically take longer than 14 days to arrive are noted on the respective ordering page. Most items are usually delivered within 10 business days. If you require quick delivery, call for a quotation.


SHIPPING DELIVERY SIGNATURE
A signature for each package is required to ensure our customers receive the products they have ordered. Should you wish to waive the delivery signature requirement, you will do so at your own risk and responsibility. We can not guarantee your package will not be stolen if it is left in a non-secure location. If you waive the signature requirement and the shipping service (typically UPS) shows they have delivered the package and it comes up missing or stolen, you agree to be responsible for all charges associated with the order including the shipping costs and cost of the product. If you wish to have your product delivered with a "no signature required" stipulation, cut and paste this entire paragraph into an email to track@ergomart.com along with your order number and we will change your delivery to no signature required. In the subject line of your email type two items: 1) NO SIGNATURE REQUIRED and 2) ORDER NUMBER: (include order number here). If you have not received an email confirmation from Ergomart within one hour verifying we have changed your order to reflect your no signature requirement, call us immediately at 888 420 3200 and speak with a customer service representative.


PRODUCT AVAILABILITY AND PRICING
Pricing and availability are subject to change without notice. We make every effort to provide accurate pricing. If a price has changed (increased or decreased) before we have a chance to change it on our website, we will contact you for reauthorization of product purchase.


SHIPPING CONSIDERATIONS AND INSTRUCTIONS
Costs shown are for orders shipped to destinations within the continental U.S. only. Ergomart only ships to Alaska, Hawaii and Puerto Rico when arrangements are made through an Ergomart representative. If you wish to ship to Alaska, Hawaii, or Puerto Rico, please call 888-420-3200 or email service@ergomart.com. If no shipping costs appear in the cart buy box or pull down menu on the product page, shipping is free. Exceptions include large items such as desks, expedited shipping, shipping outside of the lower 48, and international shipments. If you have questions about shipping costs, please call 888-420-3200 or email. We make every effort to not only keep our shipping costs as low as possible, but also to ensure that you know exactly what you are charged for.

Kindly check your order upon receipt and notify Ergomart within three business days of shipment if you are missing a part or have an issue with your order.


Most items are delivered via UPS or Fed Ex. Heavier items are delivered via common carrier. Generally speaking, common carrier deliveries do not include conveyance from the delivery vehicle into the place of final delivery. You must have or arrange the necessary equipment and appropriate means of removing the product from the tailgate of the delivery vehicle. Most deliveries of large and heavy items are done with large delivery trucks with 28 foot trailers with beds set at about 48" to 50" (standard dock height). These trucks can not make deliveries to locations without a dock-high dock or fork lift. Deliveries can be made with Lift-Gate Service at an additional cost. Call us to discuss delivery options at 1-888-420-3200 before purchasing items that mention additional costs when products are delivered to non dock-high receiving situations.

Some common carriers do not allow for delivery appointments and provide only the broadest of time frames for deliveries. In all cases we will work to help you get your common carrier products delivered with minimal hassle.


QUANTITY DISCOUNTS 
Many of the products at Ergomart are offered with an additional 3% to 5% discount on quantity purchase of five or more. If a product does not default to a discount at five units, please email or call for quote. Organizations that wish to purchase items in quantities of ten or greater should call 888-420-3200 for a quotation.

RETURN POLICY
Returns section updated April 2012: Return options, returns for multi-unit purchases, definition of non-returnable items AND Quick-Ship returns.

Ergomart backs all of our products up with a commitment to customer satisfaction. If the product is defective, we will replace the item or refund your full purchase price on any SINGLE NON-CUSTOM item you purchase from us—we will refund your money upon receipt of the returned item at no charge with the following rules and exceptions:

1) There are no refunds for Overnight, Second Day or other expedited or special shipping charges on any product under any circumstance except when the product does not arrive when promised (in writing on sales order), when the product is proven to be damaged by the shipper, the product is lost by the shipper, or the product is patently defective and temporarily usable. It is at the customer's risk as to whether or not the product will perform appropriately for its intended purpose in as far as expedited shipping charges are concerned.

2) Multiple Purchases of same item: If the customer buys two or more of the same item and decides to return the products because it does not meet the requirements for the intended purpose, the customer will be responsible for the shipping costs of the product both to and back on all products beyond the first unit. When buying a product for the first time, we always recommend that the customer try one and then buy more once the product proves to be suitable for the intended use.  Ergomart will make every effort to provide the initial unit available as rapidly as possible.

You must request authorization to return (RMA) your product within 15 days of its original shipment. Products must be returned to Ergomart within 30 days of the original ship date. We ship from several warehouses and manufacturing facilities and the product may not necessarily be returned to the shippers' address on the original box. Call Ergomart for a RMA (Return of Material Authorization). The cost of return shipping is paid for (and arranged by) Ergomart only if the product is defective. In all circumstances, the returned item must be shipped back in its original packaging material in new condition. Products that are returned missing parts, without original packaging, or without original packing slip will be assessed additional costs to replace missing parts or literature.

If you decide you do not want the product (for reasons unrelated to defects) the restocking fee is 20% plus shipping charges.
If the product was originally shipped via Quick-Ship, you must pay for cost of the original shipping PLUS a 10% restocking fee if the product performs as advertised and you have decided you do not want it.


CUSTOM / NON RETURNABLE ITEMS
MOST chairs and tables are considered custom non returnable items. At its discretion, Ergomart may agree to accept returns on certain custom products at higher restocking fees and on a case by case basis. Please call us if you are interested in purchasing a custom product and wish to understand what your options may be in the event that the product is unacceptable for your purposes for reasons other than product performance. Certain custom products may be ordered in a configuration that allows us to accept them back.


RECAP
Please return the product in its original new condition and shipping container or carton. Please do not attempt to return products without obtaining an emailed or faxed authorization (RMA) from an Ergomart representative. We will not share or sell any information about individual Ergomart customers to anyone outside this corporation unless you, the customer, explicitly request or agree to such a sharing of information. Exceptions will include the following circumstances where implicit permission is assumed or outside circumstances take precedence: A) Sharing information with our vendors and our shippers to the extent such information is vital to the needs of servicing the customer; B) Sharing information to expedite or facilitate warranty related activities; C) When required by law or court order, or as requested from law enforcement authorities, or in the good faith belief that disclosures may be necessary or advisable including and without limitation to protect the rights, properties or personal safety of, or commence or defend any claims, demands or legal proceedings by or against the Company, its officers, employees, subcontractors, agents, affiliates, and/or subsidiaries. Ergomart shall not be liable to its customers or to any third party as a result of such disclosure of data for any of the above described purposes.


Should Ergomart be purchased by a corporation, group or individual, our terms of sale will include a provision that guarantees the above described privacy protection remain in effect and perpetual for those who have purchased products from Ergomart while these provisions were originally in effect and until the date of the sale when a new policy may be developed or when and if this policy is amended.

LIMITED WARRANTY describes the time period during which Ergomart will repair or replace product or provide discounted product repairs and replacement. Generally, all non moving components are covered for the full stated limited warranty period with a full repair and/or replace opportunity provided to the user. Components that are subject to wear and degradation based on duty cycles and usage will be subject to prorating. All products that do not have specific associated language stating otherwise, are understood to be designed for use in a single shift, 5 day work week environment.


Gas spring cylinders, friction hinges, electronic motors, electronic switches, bushings, rollers, bearings and other moving and electrical components have prorated coverage. Such wear susceptible items are fully covered for a one year period excluding shipping costs. These items will be either repaired or replaced at Ergomart's sole discretion. For items with a warranty period greater than one year, the warranty value drops to either 50% (for two year warranty) or 66% (for three year warranty) for the value of the aggregate product at the end of the initial one year period. The value diminishes proportionately as the item approaches the end of the limited warranty service period. Consequently, during a three year limited warranty period, a product that is two years old will have a value of 33% of its original value. The 24 month old product would be covered without repair expense, if a repair or replacement of the warranted component or sub-assembly can be completed at a value at or less than the 33% or less of the value of the aggregate value of the product.

The remedies of the Purchaser set forth herein are exclusive, and the total liability with respect to the Product furnished hereunder, whether based on contract, warranty, negligence, indemnity, strict liability or otherwise, shall not exceed the purchase price for the Products and such remedy is the sole responsibility of the manufacturer. Ergotect Corporation's (DBA Ergomart) single and sole responsibility is to facilitate the communications between Manufacturer and Purchaser in order to assist in the logistics of replacing or repairing products that the manufacturer deems as a covered claim based on its written warranty. Ergotect Corporation, DBA Ergomart SHALL IN NO EVENT BE LIABLE TO PURCHASER FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF ANY BREACH OF ANY MANUFACTURERS' LIMITED WARRANTY OR ANY DEFECT IN, FAILURE OF, OR MALFUNCTION OF THE PRODUCTS FURNISHED HERE-UNDER, WHETHER OR NOT SUCH LOSS OR DAMAGE IS BASED ON CONTRACT, WARRANTY, NEGLIGENCE, INDEMNITY, STRICT LIABILITY OR OTHERWISE. Ergotect Corporation, DBA Ergomart shall not be liable for consequential, incidental, indirect, special or punitive damages even if the limited remedy afforded herein then fails of its essential purpose; the express intent of this agreement is that the risk of all such loss or damage shall be borne by Purchaser and/or Purchaser's insurer.
