SHIPPING ACCOUNT OPTIONS
When purchasing online through our website you can ship on your account or use one of our shipping options for deliveries within the 48 contiguous states. All other shipments and quotes to addresses outside the lower 48 states will be provided by quotation. Call or request a quote through the website shopping cart.
Texas residents and businesses are subject to 8.25% state sales tax unless you request exemption and provide the necessary paperwork in advance of purchasing. We do not provide sale tax refunds after you have made a purchase through our webportal so always be sure to submit your request to have your tax ID added to our list before purchasing.

ALTERNATIVES TO ONLINE CREDIT CARD PURCHASES
We accept faxed or mailed credit card orders, as well as orders that are mailed with a certified check. Never send your credit card information to us via an email.
PURCHASE ORDERS AND CORPORATE AND GOVERNMENTAL ACCOUNTS
Corporations and other organizations are evaluated on a case by case basis for terms. Municipal and State Agencies are generally not required to be evaluated for credit worthiness except for larger orders (over $2,500.00).
CREDIT CARD CHARGES
Credit cards are not debited until your product is prepared for shipment.
Shipping times vary. Products that typically take longer than 14 days to arrive are noted as requiring more lead time than off-the-shelf products. Most single item orders are usually delivered within 5 to 7 business days. If you require quick delivery, call to confirm immediate availability of a product.
A signature for each shipment helps us to ensure you receive the products you have ordered. Should you wish to waive the delivery signature requirement, you will do so at your own risk and responsibility. We are not able to guarantee your package will not be stolen if it is left in a non-secure location. If you waive the signature requirement and the shipping service (typically UPS) shows they have delivered the package and it comes up missing or stolen, you agree to be responsible for all charges associated with the order including the shipping costs and cost of the product. If you wish to have your product delivered with a "no signature required" stipulation, cut and paste this entire paragraph into an email to firstname.lastname@example.org along with your order number and we will change your delivery to no signature required. In the subject line of your email type two items: 1) NO SIGNATURE REQUIRED and 2) ORDER NUMBER: (include order number here). If you have not received an email confirmation from Ergomart within one hour verifying we have changed your order to reflect your no signature requirement, call us immediately at 888 420 3200 and speak with a customer service representative.

SHIPPING CONSIDERATIONS AND INSTRUCTIONS
Costs are calculated and displayed during your online purchasing process on our website for orders shipped to destinations within the continental U.S. as well as APO and FPO addresses.
Ergomart ships to Alaska, Hawaii and Puerto Rico in two ways:
When arrangements are made over the phone and or the online quote request process
Online using your own shipping account number for UPS or FEDEX

Most items are or can be delivered via UPS or FedEx. Heavy, bulky or large quantity orders can be delivered via common carrier. Generally speaking, common carrier deliveries do not include conveyance from the delivery vehicle into the place of final delivery. You must have or arrange the necessary equipment and appropriate means of removing the product from the tailgate of the delivery vehicle. Most deliveries of large and heavy items are done with large delivery trucks with 28 foot trailers with beds set at about 48" to 50" (standard dock height). These trucks can not make deliveries to locations without a dock-high dock or forklift. Deliveries can be made with Lift-Gate Service at an additional cost. Call us to discuss delivery options at 1-888-420-3200 before purchasing items that mention additional costs when products are delivered to non dock-high receiving situations. Some common carriers do not allow for delivery appointments and provide only the broadest of time frames for deliveries. In all cases we will work to help you get your common carrier products delivered with minimal hassle.

ALWAYS PHOTOGRAPH DAMAGED BOXES AND PALLETS BEFORE YOU OPEN THEM
The following steps are critical to ensure successful outcomes when damage occurs to the packaging during shipment:
Photograph damaged packages with multiple images BEFORE opening if the package has obvious damage.
Photograph each step of the process of unboxing to assist in making successful claims against the shipping service in the event they have damaged or mishandled your product.
ALWAYS save ALL packaging material as these can be a critical component for making a successful claim.
Most Ergomart products may be purchased with quantity discounting at 5, 10, 25 and 100 units. Organizations that wish to purchase items in quantity should always call 888-420-3200 for a quotation or request a quote through the onsite quote process.

Ergomart backs all of our products up with a commitment to customer satisfaction. If the product is defective, we will replace the item or refund your full purchase price on any NON-CUSTOM item you purchase from us—we will refund your money upon receipt of the returned item that is new condition in its original packaging material at no charge with the following rules and exceptions:
1) You must request a Return of Material Authorization (RMA) to return your product within 15 business days of its original shipment date. Products must be returned to Ergomart within 30 days of the original ship date. We occasionally ship from a facility other than our main warehouse in Dallas, Texas. Consequently, the product may not necessarily be returned to the point of origin. Call Ergomart at 888 420 3200 to arrange for an RMA.
2) In all circumstances, the returned item must be shipped back in the original packaging material in new condition. Products that are returned with missing parts or without original packaging will be assessed additional costs to replace missing, scratched parts or literature.
3) The return shipping is paid for and arranged by Ergomart if the product is defective.
4) If you decide you do not want the product (for reasons unrelated to defects) the restocking fee is 20% plus both the original and return shipping costs.
5) Multiple Purchases of the same item: when buying a product for the first time, we always recommend that the customer initially purchase a single unit and then buy more once the product proves to be suitable for the application. Returns for orders of multiple non-defective items are subject to the 25% restocking fee plus both the original and return shipping costs, Ergomart will make every effort to make an initial unit available for evaluation as rapidly as possible.
6) When products are damaged or significantly delayed when using Ergomart shipping options (or using prepay and add terms) and one of the following conditions apply:
the product is misplaced or misrouted by the shipper
the product is proven to be damaged by the shipper
Ergomart will file a claim against the shipper. To successfully recover the associated shipping and product costs when a product is damaged in shipment, the buyer must assist Ergomart in the claim process by adhering to the damaged shipment protocols noted above.
7) Shipments FOB Origin: If you have shipped on your own account and the product is lost or damaged, you will file a claim with the shipper to recover both shipping and product costs. Please call us for assistance.
8) There are no refunds for Overnight, Second Day or other expedited or special shipping charges on any product except when:
The product is patently defective and/or temporarily completely non functional, due to key missing components.
The product does not arrive when promised (in writing) because Ergomart did not ship the item on the agreed upon date. Ergomart reserves the right to notify customers in writing 24 hours or more before the agreed upon shipment date when our suppliers delay delivery of subcomponents, thus impacting our ability to fulfill your order.
A NOTE ON EXPEDITED SHIPPING COSTS Ergomart typically ships from its warehouses and manufacturing headquarters in Dallas, Texas. Since our products are not stocked in multiple facilities across the country expedited shipping costs may not be competitive with large retailers and ecommerce resellers that have or utilize warehouses strategically positioned within “one day” and “two day” ground shipping zones. Commodity products stocked in five strategically placed warehouses across the country can and do create the illusion for many people that overnight shipping on airplanes has become inexpensive. In fact, what is happening is that many next day and second day shipments are simply fulfilled from strategic warehouses within a day’s ground transit time. Air shipping costs are increasing.
CUSTOM / NON RETURNABLE ITEMS
Custom products designed and manufactured to meet a particular customer’s requirements are generally considered non-returnable. MOST chairs and tables are also considered custom non-returnable items. At its discretion, Ergomart may agree to accept returns on certain custom products at higher restocking fees and on a case by case basis. Please call us if you are interested in purchasing a custom product and wish to understand what your options may be in the event that the product is unacceptable for your purposes for reasons other than product performance. Certain custom products may be ordered in a configuration that allows us to accept them back.
RECAP FOR RETURNS INFORMATION
Please return the product in its original new condition and shipping container or carton. Please do not attempt to return products without obtaining an emailed or faxed authorization (RMA) from an Ergomart representative. LIMITED WARRANTY describes the time period during which Ergomart will repair or replace product or provide discounted product repairs and replacement. Generally, all non moving components are covered for the full stated limited warranty period with a full repair and/or replace opportunity provided to the user. Components that are subject to wear and degradation based on duty cycles and usage will be subject to prorating. All products that do not have specific associated language stating otherwise, are understood to be designed for use in a single shift, 5 day work week environment.
Gas spring cylinders, friction hinges, electronic motors, electronic switches, bushings, rollers, bearings and other moving and electrical components have prorated coverage. Such wear susceptible items are fully covered for a one year period excluding shipping costs. These items will be either repaired or replaced at Ergomart's sole discretion. For items with a warranty period greater than one year, the warranty value drops to either 50% (for two year warranty) or 66% (for three year warranty) for the value of the aggregate product at the end of the initial one year period. The value diminishes proportionately as the item approaches the end of the limited warranty service period. Consequently, during a three year limited warranty period, a product that is two years old will have a value of 33% of its original value. The 24 month old product would be covered without repair expense, if a repair or replacement of the warranted component or sub-assembly can be completed at a value at or less than the 33% or less of the value of the aggregate value of the product.

Ergotect Corporation, DBA Ergomart SHALL IN NO EVENT BE LIABLE TO PURCHASER FOR CONSEQUENTIAL, INCIDENTAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF ANY BREACH OF ANY MANUFACTURERS' LIMITED WARRANTY OR ANY DEFECT IN, FAILURE OF, OR MALFUNCTION OF THE PRODUCTS FURNISHED HERE-UNDER, WHETHER OR NOT SUCH LOSS OR DAMAGE IS BASED ON CONTRACT, WARRANTY, NEGLIGENCE, INDEMNITY, STRICT LIABILITY OR OTHERWISE.
